In these terms, Neigh & Nicker, we, us and our refers to our legal entity Neigh & Nicker Ltd. We act as an intermediary between Buyers and Sellers providing a service, we do not buy and sell products ourselves and are not party to any transactions.
These Marketplace Terms, together with the policies and terms referred to below, set out the conditions and rules for using Neigh & Nicker, whether as a guest or as a registered user. By using Neigh & Nicker you agree to the legal terms and conditions governing the rules, under which we allow you to buy and sell items using our marketplace which we make available to you via our site (http://www.neighandnicker.co.uk). These terms and conditions (“Terms”) form a legal agreement between you and us and govern your use of our site and services.
Use of our site includes accessing, browsing, shopping on, or registering to use our site. Please read these marketplace terms carefully before you start to access our site or use our site Neigh & Nicker. We recommend you print and keep a copy of these Marketplace Terms for future reference. By using our site, you confirm that you accept our terms and that you have read our Privacy Policy and that you agree to comply with them. If you do not agree to these Marketplace Terms, you must not use the Neigh & Nicker Marketplace.

Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue, or change all or part of our site at any time without notice. To use Neigh & Nicker, you are responsible for registering with us by setting up an account (“Account”). Before setting up your Account to list items for sale, you must have a registered account with PayPal. Sellers and Buyers who use our site Neigh & Nicker must have a registered PayPal account.
You may only use Neigh & Nicker Marketplace if:
To create an Account, you will need to provide Neigh & Nicker with your email address and choose a unique password. During the Account registration process, and at any time during your use of our services, we are authorized to ask you to verify information related to your Account such as your email address, phone number as well as any other personal details and other relevant information. We are also authorized to ask you to set up security questions for future verification of your Account.
Users of our site are permitted to have only one Neigh & Nicker Account per user and only one email can be associated with each user Account.
We will process your personal data only to fulfil our obligations and rights under the Marketplace Terms which are needed to provide you with our services. Please read our Privacy Policy here for more information about how we collect, use, store and protect your personal data.
Neigh & Nicker is a website operated by OBN Technology. We are a limited company, registered in England and Wales under company number 15320129 and with our registered office at Abbey House, Abbey Walk, Shaftesbury, Dorset, United Kingdom, SP7 8BB.
In addition to the Marketplace Terms listed above, the following additional terms, notices and policies will also apply to your use of our site Neigh & Nicker should you wish to access our site or use our site to sell goods and/or to purchase goods on Neigh & Nicker Marketplace.

We reserve the right to revise any and all of the Marketplace Terms at any time by amending this page. Please check the Marketplace Terms to ensure you understand the terms that apply at the time of use. These Marketplace Terms were most recently updated in February 2024.
You are responsible for keeping the confidentiality of your Account Login details. You must not disclose them to any third party. We have the right to disable your Account, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Marketplace Terms.
If you know or suspect that anyone other than you know your user identification code or password, you must notify us immediately at: support@neighandnicker.co.uk
You must not allow a third party to use your Neigh and Nicker Marketplace account to sell, transfer or gift your account.
We refer to the items you sell through the Neigh & Nicker Marketplace in theses Marketplace Terms as “Products”. When another user of Neigh & Nicker Marketplace purchases a product, we refer to this as a “Product Transaction”. Our FAQ here explain how to list products for sale.
You will need a verified PayPal Account to receive payment for a Product Transaction. You must be at least 18 years old and have full legal capacity to enter into a contract to open a PayPal account and use PayPal services PayPal Terms and Conditions. If you are under 18 and do not own your own PayPal account, you must seek the prior express permission of a parent or third party before using their account in relation to each Product Transaction.
To protect you against fraud, we advise you not to make or receive payments for a Product Transaction other than via PayPal. Making payment other than via PayPal creates a risk of fraud and a poorer experience for users. Making or receiving payment for a Product Transaction other than via PayPal is a breach of our Acceptable Use Policy and we take such action as we deem appropriate, which may include issuing a warning to you, withdrawing your right to use Neigh & Nicker Marketplace, taking legal proceedings against your and/or disclosing such information to law enforcement authorities as we reasonably feel is necessary. Once you have received payment for a Product Transaction:
A PayPal transaction fee will automatically be deducted from your PayPal account. The amount charged by PayPal will be dependent on the payment deduction rates linked to your PayPal account. The PayPal transaction fee will be calculated based on the total sales amount for each product; and
Neigh & Nicker charges an 8 % fee on all product transactions. The fee can be increased or decreased at Neigh & Nicker’s discretion). This fee and shipping charges are automatically deducted from your payment for each product transaction.
You are responsible for all taxes (including any associated penalties, fines, charges, and late payment interest) relating to your sales of Products through Neigh & Nicker Marketplace, except as otherwise required by law. You must comply with all applicable laws in relation to such taxes and shall promptly provide us with any information we require to verify such compliance. To the extent possible under any applicable law, you shall reimburse us on demand any costs we incur because of your failure to comply with this provision.
You agree to indemnify Neigh & Nicker and agree not to hold us responsible or liable for any loss, liability, cost, or expense arising from any third-party claim resulting from or connected to your misuse of our site Neigh & Nicker, or any use which is in breach of our Marketplace Terms.
We may from time to time provide interactive services to you on our site. Use of our interactive services by a minor is subject to the consent of parent or guardian. By submitting any content to our site or through our interactive services, you agree that we shall have a non-exclusive, perpetual, royalty-free, worldwide right and license to use, reproduce, distribute, and make available such content on our site and in our marketing material. We may, from time to time, if we consider it appropriate, moderate any interactive services provided on our site. However, we are under no obligation to do so. Moderation may be carried out automatically and/ or manually, by us or by a third party on our behalf. We do not guarantee that our site will be secure or free from bugs and viruses. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored, or any server, computer or database connected to our site. You must not attack our site via denial-of-service attack or distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement agencies, and we will co-operate with the authorities by disclosing your identity to them. These intellectual property rights are protected world-wide by copyright laws and treaties. All such rights are reserved. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death, personal injury caused by our negligence or the negligence of our employees, agents, subcontractors and for fraud or fraudulent misrepresentation.
As we are not the sellers of any products, we have no control and do not provide any commitments relating to the existence, quality, safety, genuineness or legality of products, the truth or accuracy of any picture or description of Products or any other content made available by users, the ability of sellers to sell products, the ability of buyers to pay for them or that a buyer or seller will actually complete a transaction or return the products, and we have no liability in this respect. Sellers are responsible for ensuring that any age-restricted Products are marked clearly with the applicable age restriction (as required by law) and buyers agree that they shall not attempt to purchase products if they are younger than the advertised legal age restriction.

Please note we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes but if you are a business user and you do choose to use our site, we have no liability to you for the following:
We will not be liable to you in respect of Products. We make no commitments regarding Products including the quality, delivery, price, description, or availability of the Product through our site Neigh & Nicker.

You acknowledge any agreement for the purchase of a Product is made solely between you and the seller. Any complaints, questions, claims or disputes in connection with a Product or Product Transaction should be resolved directly between the Buyer and the Seller. Where users cannot resolve issues relating to a Product Transaction, we suggest that you seek to resolve the dispute via PayPal, who are responsible for resolving disputes relating to the Sale Product.
You may link pages of our site to your personal social media accounts where social media sharing plug-ins are available on our site. Any other linking to our site is prohibited without prior consent. You must not establish a link to our site:
• In a way is inequitable and unlawful or which damages our reputation or takes advantage of it
• In such a way to suggest any form of association, approval or endorsement on our part where non exists OR
• In any website that includes unlawful or fraudulent content, has any unlawful or fraudulent purpose or effect or is in breach the content standards set out above.
